  • The legislation introduces a distinct offense for murders carried out by a group consisting of five or more individuals based on specific identity markers, such as caste, language, or personal beliefs. The prescribed penalty for this offense ranges from seven years to life imprisonment or capital punishment.

Key Issues and Analysis

  • The IPC shields individuals with an unsound mind from prosecution, but the BNS modifies this provision to cover those with mental illness. The definition of mental illness, however, excludes mental retardation while incorporating issues related to alcohol and drug abuse. Consequently, individuals with mental retardation may face prosecution, whereas those voluntarily intoxicated might be exempted from legal consequences.
  • The scope of terrorism, as per the BNS, encompasses acts intending to disrupt public order. This broad definition raises the possibility of categorizing local breaches of peace as acts of terrorism.
  • The age of criminal responsibility remains at seven years but can extend to 12 years based on the maturity of the accused, potentially conflicting with international conventions’ recommendations.
  • Numerous offenses in the BNS overlap with existing special laws, often prescribing different penalties or procedures. This may result in multiple regulatory frameworks, increased compliance costs, and the potential for facing multiple charges.
  • In a noteworthy distinction, murder committed by a group of five or more people based on certain identity grounds carries a lesser penalty than individual murder.
  • The BNS excludes Section 377 of the IPC, previously read down by the Supreme Court. This exclusion results in the removal of rape of men and bestiality as criminal offenses.

Key changes in the BNS include:

  • Offences against the person: The IPC encompasses crimes such as murder, abetment of suicide, assault, and causing grievous hurt. The BNS retains these provisions and introduces new offences like organized crime, terrorism, and group-related murder or grievous hurt based on certain grounds.
  • Sexual offences against women: The IPC addresses acts such as rape, voyeurism, stalking, and insulting the modesty of a woman. The BNS preserves these provisions but raises the age threshold for the victim to be considered a major in gang rape from 16 to 18 years. It also criminalizes sexual intercourse with a woman through deceitful means or false promises.
  • Sedition: The BNS eliminates the charge of sedition and introduces penalties for (i) exciting or attempting to excite secession, armed rebellion, or subversive activities, (ii) encouraging separatist activities, or (iii) endangering the sovereignty, unity, and integrity of India. These offences may involve verbal or symbolic expressions, electronic communication, or the use of financial means.
  • Terrorism: The BNS defines terrorism as an act intending to (i) threaten the unity, integrity, and security of the country, (ii) intimidate the general public, or (iii) disturb public order. Punishments for attempted or committed terrorism include (i) death or life imprisonment and a fine of Rs 10 lakh if it results in death, or (ii) imprisonment ranging from five years to life and a fine of at least five lakh rupees.
  • Organized crime: This category includes offences such as kidnapping, extortion, contract killing, land grabbing, financial scams, and cybercrime conducted on behalf of a crime syndicate. Attempting or committing organized crime is punishable by (i) death or life imprisonment and a fine of Rs 10 lakh if it results in death, or (ii) imprisonment ranging from five years to life and a fine of at least five lakh rupees.
  • Mob lynching: The BNS introduces murder or grievous hurt by five or more people based on specified grounds as an offence. These grounds include race, caste, sex, language, or personal belief. The punishment for such murder is a minimum of seven years imprisonment to life imprisonment or death.
  • Supreme Court rulings: The BNS aligns with certain Supreme Court decisions, such as excluding adultery as an offence and incorporating life imprisonment as a penalty (in addition to the death penalty) for murder or attempted murder by a life convict.
